In spite of the fact that Northern Virginia geographically surrounds a good portion of the Capitol of The United States and contains huge numbers of people on the Federal Payroll, Northern Virginia Bankruptcy is significantly on the rise.

We know that 99% of you never expected to need to file for

going broke there is help

We can stop the madness

Bankruptcy. My name is Jad Sarsour, I am a Northern Virginia Bankruptcy Attorney and I have helped many Virginia residents though the trials of financial hardship..

This year in this country a million people will file Bankruptcy. In Northern Virginia we expect over 16,000 will file this coming year. As the credit meltdown comes into full steam with the 2005, 5 year option arms hitting now, in 2010, this mess is going to get worse. If you are underwater don’t be embarrassed to reach out a hand to a Northern Virginia Bankruptcy Attorney for help. It is not illegal and you are entitled to the leg up. The united states Bankruptcy code is here to help the insolvent get back on their feet. Do not be embarrassed, thousands upon thousands of good solid citizens are getting swept away in this financial tsunami. It was not your fault. We are doing chapters for the most conservative as well as aggressive consumers.

For most Virginia residents in serious financial distress, Bankruptcy still works. Please take the time to read my website, make sure you get to the QWR and forensic auditing sections, and then call me if you want to find out if Bankruptcy is your best option. These sections of the web site give you great information on things you can do now to start your battle with creditors.

The new Bankruptcy law introduced in ’05 was engineered by the banks to force people out of Chapter 7 (get rid of all of your unsecured debt )Bankruptcy and into Chapter 13 (consolidation, court controls you)  Bankruptcy.

That law was written by large mortgage companies and bank lobbyists who maintained to the federal government and the people that our economy was the pinnacle of capitalism and would grow forever , and there was, under these circumstances no reason whatsoever why anyone shouldn’t be able to pay all of their bills. Well they were quite wrong. Look where we are today just here in Northern Virginia where the economy has the full support of the Federal Payroll.

Those Lenders have now borrowed over 15 trillion dollars from the Future earners in this country. Unbelievably, this amounts to $100,000 for each American family–to get the lenders  through the same financial crisis that they created.

The credit and mortgage meltdown crisis has pulled down millions and millions of people just like you. Responsible people, people who regularly pay their bills and use only the financial instruments offered to them by the large banks for their personal business, relying on the regulators and the federal government to keep it all honest. People who trusted the SYSTEM! Well, the system broke. And Nobody offered you a $100,000 zero interest government loan, did they? How would it have been different to let these large irresponsible banks go under and give the $100,000 to each family. An interesting economical debate.

The Bankruptcy law, first passed in 1898, is still there. The 2005 changes made the paperwork harder and the regulations trickier, but most people in Northern Virginia can still get the debt relief they need. Bankruptcy still works in Northern Virginia.

So what is this new Bankruptcy Law created in 2005?

Well this law requires that the court assign a monthly reasonable budget for your debts. Your car, food, housing, clothing etc etc Some of the numbers in that assigned budget, are pretty fair, some are absolutely insane

Here’s a great one. Northern Virginia Bankruptcy residents are only allowed $230 per month to cover car expenses–gasoline, insurance, car repairs, maintenance, tires, tolls, everything.

For people with long commutes (and by the way residents of Prince William County, Virginia, have the longest average commute of anywhere in the country, outside of New York City), the $230 wont even cover your gas to work even if you drive a prius or a nissan cube.

However, we know the game, we’ve played it many times and we can most assuredly get your budget to work and your Chapter 7 Bankruptcy approved.

Trust me, the Banks and Mortgage companies who wrote this new law were looking after their own interests, but in general isn’t an economy stronger if the interests of the PEOPLE are served by Government? Luckily some breaks were written into the law. Navigating these with a seasoned Northern Virginia Bankruptcy Attorney will make an enormous difference in your outcome. Not all Bankruptcy Attorneys are alike.

With good counsel, an experienced Northern Virginia Bankruptcy Attorney can set you up to take advantages of the breaks, and offset the areas where the law is unfair.

This means we will do everything that is legally allowed by the Northern Virginia Bankruptcy Law (Federal Bankruptcy code) to arrange your situation and present it to the court, so that you can get approved for a Chapter 7 Bankruptcy where we wipe out all of your unsecured debt and manage your secured debt like the professional and caring Northern Virginia Bankruptcy Attorneys we are. (Assuming, that Chapter 7 is your best option as it normally is.)

When someone cant pay their bills, it’s hard for the court to argue that they can. It’s fairly black and white.

And if you end up in Chapter 13, we’ll fight to the last tooth to keep down your payment schedule to the absolute legal minimum, so that you have a lot more breathing room. People this is what you pay me for, my expertise in this exact area, my experience, my contacts, my fighting for YOU. I may have a gentle demeanor with you but trust me, I am a fighter for my client.

Here are my problems with the New Bankruptcy Law

The 2005 Bankruptcy amendment added a lot of additional code. Doubling the size of the Bankruptcy statutes. Dramatically enhancing the courts ability to deny Chapter 7 and force you into a court monitored repayment plan or Chapter 13.

Your paperwork is a lot harder. Under the old law there was a presumption that you were eligible to file a Chapter 7 Bankruptcy if you were broke. But now there is a much stronger burden of proof.

There are requirements, hurdles to jump, you have to start by taking two debt management education classes on the internet, you have to save all of your pay stubs for six months and show the court your social security card, your tax forms and bank statements.

The people behind the new law sold Congress on the idea that all these requirements and paperwork would make the system more honest. The result–which is what the lobbyists really wanted–is that people who are distracted and worried sick–like you, right now–have all this additional burden to face. They want to break you down, make you give up, force you to make mistakes that they can use to beat you into Chapter 13 submission so that the courts can control your finances and give the banks your money. This is how these new bankruptcy laws were crafted, for the banks by the banks.

The bank lobbyists wrote the new law with a goal of making it so

complicated that you are destined to fail. My job is to set up your file in such a manner that you succeed. I am very very good at this.

Another thing to think about: There are Investigators from the Justice Department now checking you out, doing computer searches, checking out all the known assets in your name, your spouses name, other property, transfers of cash and other liquid assets. It’s no playground now to try and hide your assets and do a chapter. Don’t try it. It doesn’t work. They look at your bank statements and tax forms. The patriot act may help the NSA and CIA to find terrorists but it just might have had a few other side consequences to the good citizens of the United States. This is not the same United States we live in. But knowing a good Northern Virginia Bankruptcy Attorney who can navigate you through the process will help you stay out of trouble in the Northern Virginia Bankruptcy process. Let us help you..

To get through all this, you need all of your documents, you need discipline and you need the right plan. This is what we are here for, to help you through the Northern Virginia Bankruptcy process. All of this stuff may be hard to put together when you are on the ropes and stressed out about money. Put what documents you can together and let us make your plan for you. We will tell you what to gather and where to find it if it is not in your possession right now. If you are late on a mortgage, We will show you how to do a QWR to force your mortgage lender to stop reporting you as late to the credit and get a fresh set of mortgage documents from your lender.

One more thing. The new law is tough on people with large families; the government is likely to claim that people with more than two or three children are spending more than they need on food and clothes, when all you are trying to do is take care of your families. This is doubly true here in Northern Virginia where everything is very expensive. This is what pisses me off the most, banks running government for banks. Welcome to the Goldman Sachs economy. Northern Virginia Bankruptcy Attorneys see this all the time.
